Terms of service
These are the rules for using Muted Tune, in plain words. Last updated: October 17, 2026.
Muted Tune is run by Turbulent.net Inc. of Coquille, Oregon ("we"). By creating an account or using a band's page you agree to these terms. If you don't agree, please don't use Muted Tune.
What Muted Tune is
Muted Tune lets a band play back its practice recordings on a phone, with your own part muted. A band can also have its own web address and a small public page. A band is the group of people who use it together; a band admin is a member who manages the band.
The software, the site and the documentation are © 2026 Turbulent.net Inc. Bands keep ownership of their recordings, songs, pictures and text.
Your account
- You must be at least 13, or the minimum age where you live if that is higher. If you are under 18, a parent or guardian must agree to these terms for you.
- Give us true details and keep your password to yourself. Tell us if someone else gets into your account. You are responsible for what happens under it.
- A band admin decides who is in the band and can remove people. Admins can also delete the band.
Acceptable use
Please don't:
- break the law, or help anyone else to;
- upload or publish anything that harasses, threatens or targets people, or that is hateful or sexually explicit;
- upload or publish anything you don't have the right to share;
- try to get into accounts, bands or systems that aren't yours, or overload or disrupt the service;
- send spam, or mislead people about who you are;
- use the service to build a copy of it, or to gather other people's information.
Your music and your responsibility for it
Your music stays yours. We only use it to run the service for you: to store it, to play it back to the people you allow, and, for a public band page, to show the page you chose.
You promise that you own, or have permission to share, everything you upload. For a public page the bar is higher: a public page may only play music the band wrote, or otherwise owns all the rights to. No covers. The same goes for the band's picture, name and text. Playing covers in private, inside your band, is not affected.
A band admin ticks a box to publish a page, saying the music is the band's own and the band has the rights to share the recording publicly. That promise is the band's, not ours.
By publishing a page you let us show it as you set it up and make the copy of the song it plays (a stereo mix of one song or an excerpt). That permission ends when you unpublish the page or delete the band.
Band pages and addresses
- A band page is off until a band admin publishes it, and an admin can unpublish it at any time. Anyone with the address can see and hear a published page, so don't put on it anything you wouldn't want the world to see.
- We may switch public pages on or off for every band while Muted Tune is in beta.
- Links on a page are the band's own choice. We don't check them and aren't responsible for the sites they lead to.
- Don't pretend to be another act, and don't use a trademark you don't own. If we get a valid complaint about an address, we may give it to someone else; the old address then forwards to the new one for 30 days.
- The address and page are included free during the beta. Later they are part of the paid band plan. A band whose plan has lapsed becomes read-only and its public page goes offline. Nothing is deleted.
Reports and takedowns
Every public page has a "Report this page" link. Use it if a page breaks these terms or uses your work without permission.
- We may hide a page at once, because of a report or because of a legal risk, without asking first.
- We tell the band's admins right away, and give them the reason. The band can answer us, and we restore the page if the report was wrong.
- We may also remove anything else that breaks these terms.
Copyright complaints
Send copyright notices to our designated agent: Copyright Agent, Turbulent.net Inc., legal@mutedtune.com.
To send a notice, include:
- your name and a way to reach you (email, and a phone number or address if you can);
- a description of the work you say has been copied;
- the address of the band page, or of the material, that you say copies it;
- a statement that you believe in good faith that the use is not allowed by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner of the right, or are allowed to act for the owner;
- your physical or electronic signature.
What we do. We may remove or hide the material and tell the band. If you are the band and you think we got it wrong, you can send us a counter-notice with:
- your name, contact details and signature;
- a description of the material and where it was before it was removed;
- a statement, under penalty of perjury, that you believe in good faith that it was removed by mistake or because it was wrongly identified;
- a statement that you agree to the jurisdiction of the federal court for your address (or, outside the United States, for any district where we can be found) and that you will accept legal papers from the person who sent the notice.
If the person who complained doesn't tell us within 10 to 14 business days that they have started a court case, we may restore the material.
Repeat infringers. We close the accounts and bands of people who repeatedly infringe copyright.
Closing an account or a band
- You can delete your own account from your account page at any time.
- A band admin can delete the band. The band has 7 days to change its mind. When that grace period ends, the recordings and the band's records are erased within 7 days, and its public page and address stop working.
- If you leave or are removed from a band, you lose access to its music at once.
- Backups, once we have them, roll off within 30 days.
- We may close an account or band that breaks these terms. We can also close or change the service; we will give notice if we can, and a band can download everything it uploaded first.
Beta, no warranty and limits
Muted Tune is provided "as is", during the beta and after. It may be slow, change, lose a feature or stop working, and we don't promise it will always be available or free of mistakes. Keep your own copies of recordings you care about.
As far as the law allows, we are not responsible for lost data, lost income or indirect harm from using, or not being able to use, Muted Tune. Our total responsibility to you for anything is limited to the greater of what your band paid us in the 12 months before the problem, or $50.
Law and courts
These terms are governed by Oregon law. Disputes go to the state courts in Coos County, Oregon, or the federal court for the District of Oregon. This doesn't take away any rights that the law where you live gives you as a consumer.
Privacy
How we handle your information is in the privacy policy.
Changes
If we change these terms, we'll update this page and its date, and tell band admins before a change that matters takes effect. If you keep using Muted Tune after that, you accept the new terms.
